What is the classification of Uber workers?
Uber and Lyft drivers are classified as independent contractors, not employees. This classification was upheld by a California Supreme Court ruling affirming a 2020 ballot measure (Proposition 22). The decision overrides previous rulings that suggested employee status, solidifying the contractor classification for these ride-sharing companies.
Okay, so, Uber drivers… independent contractors. Right? It’s weird, isn’t it? I mean, they’re driving around for Uber all day, practically wearing the brand (not literally, of course!). You’d think they’d be employees, wouldn’t you? But nope. They’re contractors.
It’s all because of this big legal thing in California, Proposition 22. They had a vote, and it decided – boom! – contractors. Even though there were some court cases before that, you know, hinting they should be employees. Like, I remember reading something about a judge saying the control Uber has over drivers… felt very “employee-ish.” I can’t remember exactly where I saw that though. Probably some news article online. But anyway, Prop 22 kind of swept all that aside.
So now it’s settled, I guess. Uber and Lyft drivers? Independent contractors. Which is kinda crazy when you think about it. Like, my cousin drives for Lyft part-time. He has to pay for his own gas, his own car maintenance… It’s a lot. If he was an employee, wouldn’t he get some of that covered? It just… makes you wonder. Doesn’t it make you wonder?
